The 25TH JUDICIAL COURT CIRCUIT is a court of GENERAL JURISDICTION, meaning that it hears all types of cases originating in the County, including appeals from special jurisdiction courts, such as the Family Court or the Magistrate Court.

The Circuit Court is where all criminal felony trials are conducted and where misdemeanor convictions are appealed. Felonies are those crimes punishable by incarceration in a State Penitentiary for at least one year, in addition to possible monetary fines. Misdemeanors are those crimes punishable by incarceration in a Regional Jail for up to one year, in addition to possible monetary fines.

The Circuit Court also hears all civil cases, such as personal injury, malpractice, boundary line disputes, appeals of domestic relations cases from the Family Court, appeals of judgments from Magistrate Court and all other lawsuits brought by individuals and companies.

All orders of the Circuit Court are appealable to the West Virginia State Supreme Court of Appeals.

The 25th Judicial Court Circuit, comprised of Boone County and Lincoln County, is part of the West Virginia Court System. For a summary description of all of our State’s courts, see the online article The West Virginia Judicial System, published by the West Virginia State Supreme Court of Appeals.
